Welcome to Fermently! These Terms of Service ("Terms") govern your use of the Fermently mobile application (the "App"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

You acknowledge that you are using a Beta version of the App. The App is provided on an "AS IS" and "AS AVAILABLE" basis. Because this is a Beta version, it may contain bugs, errors, or inaccuracies that could cause failures, corruption, or loss of data.

Currently, Fermently uses local/anonymous device storage. We strongly advise against deleting the App, as your fermentation logs may be permanently lost until cloud synchronization is fully implemented.

Fermently is a tracking and logging utility designed for hobbyists and professionals. It is NOT a substitute for professional food safety training, laboratory testing, or common sense.

By using the App, you acknowledge and agree to the following:

• Food Safety Risk: Fermentation involves cultivating bacteria and yeast. Improper fermentation can result in severe illness, including botulism or food poisoning. You are solely responsible for verifying the safety, pH levels, and edibility of your ferments.
• Physical Hazards: Fermentation produces gas that can create immense pressure in sealed containers, potentially causing glass jars or bottles to explode, leading to property damage or severe injury. You are solely responsible for properly burping, airlocking, and storing your vessels.
• No Guarantees: Any timelines, nutrient schedules (e.g., TOSNA), or notifications provided by the App are general estimates and educational guidelines. Fermently does not guarantee that a batch will be safe to consume or successful based on App notifications.

FERMENTLY AND ITS CREATORS ASSUME NO LIABILITY FOR ANY ILLNESS, INJURY, OR PROPERTY DAMAGE RESULTING FROM YOUR FERMENTATION ACTIVITIES.

You may upload photos, notes, and recipes ("User Content") to the App. You retain all ownership rights to your User Content. However, you agree not to upload any content that is illegal, offensive, or violates the rights of others. We reserve the right to delete any User Content that violates these Terms, though we do not actively monitor private logs.

The App, including its original code, design, graphics, and features, is owned by Fermently and is protected by copyright, trademark, and other intellectual property laws. You may not reverse-engineer, copy, or distribute the App without our explicit permission.

While the Beta version of the App is currently provided for free, we reserve the right to introduce paid features, subscriptions, or paywalls in the future. We will provide clear notice and obtain your consent before any features you currently use require payment.

To the maximum extent permitted by law, Fermently and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the App; (b) any conduct or content of any third party on the App; or (c) unauthorized access, use, or alteration of your transmissions or content.

We reserve the right to modify these Terms at any time. We will notify users of any material changes by updating the "Last Updated" date at the top of this document or via an in-app notification.
